1. Scope and incorporation into the contract
These terms are intended for agreements with Edelmann Garage GmbH covering vehicle sales, workshop services, servicing, repairs, diagnostics, vehicle detailing and Edelmann Care, polishing and protective coatings, engine and chassis cleaning, bodywork, Pick-up & Return, vehicle transport, mobile services, and replacement parts and accessories. Section 17 also applies to introductions to finance and leasing providers. The services actually agreed and available for the vehicle concerned are decisive.
The approved version will be made available to customers before the contract is concluded and will form part of the contract only if agreed. Individual agreements take precedence. Merely visiting the website or making a non-binding enquiry does not constitute acceptance. Mandatory statutory rights remain unaffected. This draft is not incorporated into ongoing orders.
2. Enquiries, quotations and orders
An online appointment enquiry is not a binding booking. An automatic acknowledgement confirms receipt only. Edelmann Garage confirms the appointment and scope of services personally; an order arises when the parties reach a mutual agreement. Customers have the opportunity to review the scope, pricing basis and applicable terms before giving their consent.
Quotations specify the services, pricing basis and, where applicable, their validity period. Whether an estimate or diagnostic assessment is chargeable, and the amount payable, will be agreed in advance. A diagnostic assessment does not oblige the customer to commission subsequent repairs.
3. Prices and additional work
Prices are stated in Swiss francs. For private customers, an agreed total price includes the taxes due and unavoidable surcharges. Indicative and “from” prices provide guidance for the specified minimum scope; the vehicle, specification, condition and selected services determine the actual price. Work described as “subject to quotation” or “on request” is commissioned only once the price has been agreed.
An agreed fixed price will not be increased solely because the internal workload is greater than expected. If unforeseen additional work becomes apparent during work charged by time or based on an estimate, Edelmann Garage will explain the cause, scope and expected additional cost. Additional work and necessary price changes will be agreed before execution. Without authorisation, the additional work concerned will be deferred, unless immediate protective measures are necessary to avert a specific loss and are legally permitted. Such measures will be documented and communicated without delay.
4. Appointments, rescheduling and cancellations
Changes to appointments and cancellations should be communicated as early as possible by phone or email. If a delay at Edelmann Garage becomes foreseeable, the customer will be informed and the next steps agreed. Statutory rights in the event of delay remain applicable.
No automatic flat-rate charge applies to late cancellations or missed appointments. Compensation may be payable only where there is a statutory entitlement: it is limited to substantiated, reasonable loss or unavoidable costs. Costs saved and any alternative use of the appointment will be taken into account; customers may demonstrate that the loss was smaller or that no loss occurred. Mandatory rights of termination and withdrawal remain reserved. Any later flat-rate arrangement requires separate review and prior agreement before use.
5. Vehicle handover
At handover, the vehicle details, mileage, keys provided, visible damage and agreed work will be recorded jointly where possible. Known technical features, repainted areas, wraps, sensitive materials and safety-related defects must be disclosed. A handover record documents the observed condition; it is not a general waiver of subsequent claims.
Personal belongings and valuables should be removed in advance. Items that need to remain in the vehicle must be identified at handover. This does not remove Edelmann Garage’s statutory duties of care or liability. Keys will be used only within the agreed scope and returned when the vehicle is handed back.
6. Pick-up & Return and vehicle transport
The location, time, vehicle condition, costs and suitability of collection and return will be agreed separately. Driving the vehicle for collection and return adds the mileage necessary for the journey. The route and estimated mileage will be agreed in advance; private journeys that have not been agreed are excluded. The vehicle must be safe and legally permitted to undertake the agreed journey. Registration and the required insurance cover will be clarified before it takes place.
Transport on a vehicle transporter depends on availability, dimensions, weight, ground clearance and the ability to load the vehicle. The costs and terms of any transport partner engaged will be disclosed and agreed before commissioning. Vehicle condition, mileage and keys will be recorded at collection and return. Selecting an option online alone does not guarantee a suitable form of transport.
7. Mobile Edelmann Care
Mobile services require an authorised, accessible and safe working location. Space, electricity and water requirements, as well as environmentally appropriate collection and disposal of residues, will be clarified in advance. Customers provide only the infrastructure expressly agreed and obtain the necessary permission to use the working location.
Weather, temperature, ground conditions or surroundings may prevent professional execution. In that case, the appointment, scope or an alternative working location will be agreed together. Rescheduling for these reasons does not automatically trigger a cancellation charge. Work requiring specific facilities or unsuitable for mobile execution will not be carried out as a mobile service.
8. Workshop services, repairs, diagnostics and replacement parts
The agreed order is the starting point. Diagnostic findings and recommended measures will be explained; diagnostics may involve work in their own right, even if no subsequent repair is commissioned. The type and suitability of replacement parts, accessories and any customer-supplied parts will be agreed. Changes to the agreed scope require authorisation under section 3.
Technically necessary functional checks and test drives may form part of the agreed workshop order. They will be limited to what is necessary. Particular restrictions will be discussed in advance. A successful check does not provide a general assurance that all vehicle components not examined are free from defects.
9. Detailing, polishing and protective coatings
The achievable result depends in particular on the initial condition, material, age and pre-existing damage. Complete removal of all scratches, stains, odours or other signs of use is assured only where expressly agreed and technically justifiable. The duty to perform careful, professional work remains.
Before polishing and paint correction, the appropriate method and its limitations will be assessed. Material removal, thin or previously damaged paint layers and sensitive surfaces may limit the scope. The effectiveness and durability of protective coatings also depend on use, care and environmental factors; a specified lifespan applies only where expressly promised with the associated conditions. Identified risks will be discussed before work begins.
10. Engine and chassis cleaning
This work is undertaken only after assessing condition, access and sensitive components. Electrical and electronic components, seals and existing damage may limit or prevent the work. There is no entitlement to have every vehicle cleaned by every method. If safe execution is not possible, alternatives or omitting the work will be discussed. This does not exclude responsibility for professional execution.
11. Windscreens and driver assistance systems
Before a windscreen is replaced, the damage, vehicle specification and suitable replacement glass will be assessed. The order includes the agreed professional installation. Existing cameras, sensors and driver assistance systems, together with vehicle-specific manufacturer requirements, will be taken into account.
Whether calibration, diagnostics or other follow-up work is required, and whether Edelmann Garage or a suitable specialist can perform it, will be clarified before the order is placed. Such services form part of the order only when expressly confirmed. Required approvals, waiting periods and restrictions on use will be communicated before handover; unrestricted readiness for use is not assured while safety-related follow-up work remains outstanding.
12. Payment and late payment
The agreed payment terms apply. Unless otherwise agreed, the invoice amount is due at handover or on completion of the agreed service. Deposits will be agreed before the order is placed. Available payment methods will be communicated when the order is placed or invoiced. This does not create an entitlement to instalments, a particular payment service or a subscription.
The statutory requirements govern when payment is overdue and the consequences. Late-payment interest and other costs will be claimed only to the extent legally permitted or validly agreed. No disproportionate flat-rate reminder or collection charges are provided for.
13. Collection and retention
Following notification that the work is complete, collection within a reasonable period will be agreed. If a vehicle remains longer, the customer will be contacted and given a reasonable additional period. Any storage costs must be transparently agreed before they arise, including their start date and amount, and must be reasonable and actually incurred; there is no retrospective automatic storage charge.
A vehicle may be retained only where the statutory requirements are met. These terms do not create any additional lien, enforcement or disposal rights. Disposal will not take place unilaterally outside the statutory procedures.
14. Defects and warranty
Customers should inspect the vehicle or service on return insofar as reasonably possible and report apparent defects promptly and hidden defects on discovery. Statutory inspection and notification duties and time limits remain applicable; these terms do not introduce an additional shortened deadline that extinguishes claims.
Edelmann Garage will be given the opportunity to assess the complaint and, where provided for by law or mutually agreed, remedy it professionally. This does not exclude further statutory remedies for defects. If a defect affects safety, further use should be avoided until the matter is clarified. Necessary urgent measures and statutory claims for reimbursement remain reserved.
15. Liability and pre-existing damage
Edelmann Garage is liable under the applicable statutory provisions. These terms exclude neither intent nor gross negligence and contain no general exclusion of liability. Mandatory liability rules, particularly for personal injury, remain unaffected.
Existing damage and the documented condition of materials will be considered when determining the cause. Pre-existing damage does not remove responsibility for additional damage caused or negligent work. Cooperation, mitigation of loss and evidential matters are governed by applicable law; no general reversal of the burden of proof to the customer’s disadvantage is agreed.
16. Vehicle sales and test drives
For vehicle purchases, the vehicle, condition, promised characteristics, known damage, price, payment, handover and warranty terms will be recorded in a separate purchase contract. Information is provided to the best of our knowledge on the basis of the available documentation. Advertisements do not replace this specific agreement; expressly promised characteristics remain binding.
Test drives will be agreed in advance. Driving licences, authorised drivers, insurance cover and any excess will be clarified before the drive. Unlimited automatic responsibility for damage is not assumed. Payment, transfer of ownership and handover take place under the purchase contract and applicable law. Supplementary purchase terms will be made available before the contract is concluded; mandatory consumer protection remains reserved.
17. Finance and leasing
Edelmann Garage forwards enquiries to the relevant finance or leasing provider and does not itself approve financing. Assessment, approval and contractual terms are the responsibility of that provider. A corresponding contract is concluded separately following its assessment and the customer’s consent. Statutory information and protection duties remain applicable. Any intermediary fees will be disclosed and agreed in advance.
18. Privacy
The processing of personal data is explained in the separate privacy notice. This is distinct from the contractual terms; accepting terms and conditions does not replace any consent that may be required under data protection law.
Review note: the separate privacy notice remains a draft in the local project. It must be completed before public use and linked accessibly here and within the intended enquiry processes.
19. Swiss law and jurisdiction
Swiss law applies unless mandatory protective provisions take precedence. Statutory rules on jurisdiction apply to disputes. In particular, these terms do not restrict mandatory consumer jurisdictions or consumer protection rights.
To be checked before approval
This draft requires legal and operational review, particularly regarding contract types and remedies for defects, cancellations, payment and collection procedures, transport and insurance, and the calibration services actually available. Before its first contractual use, the approved version must be provided in good time; a footer link alone does not replace incorporation before the contract is concluded. This draft has not subjected existing enquiry forms to new contractual terms.
